Terms of Service

These Terms of Service govern the sale of products by GB Tachopak Ltd ("Tachopak", "we", "our" or "us") to the customer ("you" or "the Buyer"). By placing an order with us, you agree to be bound by these Terms of Service.

Definitions

In these Terms of Service:

• Buyer means the person or organisation purchasing goods from GB Tachopak Ltd.
• Goods means the products supplied by GB Tachopak Ltd.
• Price means the price of the Goods, excluding VAT and any applicable delivery charges unless otherwise stated.
• Seller means GB Tachopak Ltd.
• Terms means these Terms of Service.

Orders

All orders placed through our website constitute an offer to purchase Goods subject to these Terms of Service.

Acceptance of an order takes place when the Goods are dispatched.

We reserve the right to refuse or cancel any order where necessary.

By placing an order through our website, you confirm that you have read and accepted these Terms of Service.

These Terms of Service constitute the entire agreement between GB Tachopak Ltd and the Buyer in relation to the sale of Goods and supersede any previous agreements relating to such sales.

These Terms of Service may only be varied with the written agreement of a Director of GB Tachopak Ltd.

Pricing

All prices displayed on our website are exclusive of VAT unless otherwise stated.

VAT will be charged at the applicable rate at the time of invoicing.

Delivery charges are additional unless otherwise stated and will be shown during checkout where applicable.

We reserve the right to amend prices at any time before an order is accepted.

Payment

Payment for online orders must be made in full before goods are dispatched.

Trade credit facilities are available only by prior agreement and are not available through our online store. If you are interested in opening a trade account, please contact us.

The Buyer shall not withhold payment or exercise any right of set-off or counterclaim against invoices submitted by GB Tachopak Ltd unless required by law.

Product Information

The quantity and description of the Goods supplied shall be those shown on our website, confirmed by telephone or contained within any written quotation or order confirmation.

Whilst every effort is made to ensure product descriptions, images and specifications are accurate, manufacturers may alter product specifications or functionality without notice. There may occasionally be a delay before such changes are reflected on our website.

Product images are for illustrative purposes only and may vary slightly from the Goods supplied.

Warranty

GB Tachopak Ltd warrants that the Goods supplied will correspond with their description at the time of delivery.

Except where the Buyer is dealing as a consumer or where otherwise required by law, all other warranties, conditions or terms relating to fitness for purpose, quality or condition of the Goods are excluded.

Delivery

Delivery of the Goods will be made to the delivery address provided by the Buyer using our chosen delivery partners, including but not limited to DPD and Royal Mail.

We will use our reasonable endeavours to dispatch orders received before 3:00pm Monday to Thursday on the same working day. Orders received after this time, on Fridays, weekends or public holidays will normally be dispatched on the next working day unless otherwise agreed.

Any delivery dates or "next day delivery" services are estimates only and cannot be guaranteed.

Time of delivery shall not be of the essence of the contract.

GB Tachopak Ltd shall not be liable for any loss or damage resulting from delayed or incomplete deliveries caused by third-party carriers or circumstances beyond our reasonable control.

Where only part of an order is delivered, the Buyer agrees to accept the Goods supplied as part performance of the contract.

Delivery Charges

Standard UK delivery is charged at £7.50 per order.

Orders over £100 qualify for free standard UK delivery.

Free delivery does not apply to certain larger, heavier or higher-value items that require additional delivery charges based on weight, size, value or delivery location. Any applicable surcharge will be confirmed before dispatch.

Deliveries to Northern Ireland and the Scottish Highlands are charged separately according to location, weight, size and value of the Goods. Please contact sales@tachopak.co.uk for a delivery quotation.

Inspection and Acceptance of Goods

The Buyer should inspect all Goods immediately upon delivery.

The Goods shall be deemed accepted 48 hours after delivery unless the Buyer notifies GB Tachopak Ltd otherwise.

Any shortages, damage or defects that would reasonably be identified during inspection should be reported in writing, preferably by email to sales@tachopak.co.uk, within 5 working days of delivery.

Once the Goods have been accepted, or are deemed to have been accepted, they may not be rejected except where the Buyer has statutory rights to do so.

Risk and Ownership

Risk in the Goods passes to the Buyer upon delivery to the nominated delivery address.

For customers purchasing on approved credit terms, ownership of the Goods shall remain with GB Tachopak Ltd until payment has been received in full, including any interest or associated costs.

Until ownership passes, the Buyer shall hold the Goods on behalf of GB Tachopak Ltd and store them separately so they can be clearly identified as the property of GB Tachopak Ltd.

If payment is not received in accordance with the agreed terms, GB Tachopak Ltd reserves the right to repossess the Goods and enter any premises where the Goods are reasonably believed to be stored for that purpose.

GB Tachopak Ltd reserves the right to recover the price of the Goods notwithstanding that ownership has not yet passed.

Returns

Returns are handled in accordance with our Returns & Refund Policy, which forms part of these Terms of Service.

Limitation of Liability

Nothing in these Terms of Service excludes or limits liability where it would be unlawful to do so.

Subject to this, GB Tachopak Ltd shall not be liable for any indirect, consequential or economic loss arising from the supply, delivery or use of the Goods.

Changes to These Terms

GB Tachopak Ltd reserves the right to amend these Terms of Service at any time. Any changes will apply to orders placed after the revised Terms have been published on this website.

Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the laws of England and Wales.

Any dispute arising in connection with these Terms of Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
